Agreement between User and Different World

Booking Terms and Conditions

The User represents and warrants that he or she is at least 18 years of age and has the legal capacity to enter into this Agreement and to use this Web site in accordance with all terms and conditions herein.

The booking facility on this Web site is provided solely to permit the User to determine the availability of travel-accommodation related goods and services and to make reservations or otherwise transact related business with suppliers of the accommodation services provided on the web site, and for no other purposes.

The User warrants that where the booking or any part thereof is made on behalf of another person, the User is legally authorized to act for that person as their agent.

The User agrees to abide by the terms or conditions of purchase imposed by any supplier with whom the User elects to deal including, but not limited to, payment of all amounts when due and compliance with all rules regarding availability of accommodation, products or services, including inter-alia any cancellation fees. Where possible Different World will make available the suppliers’ terms and conditions but does not accept responsibility in relation thereto.

The User hereby agrees to be completely responsible for all charges, fees, duties taxes and other similar assessments arising out of the use of this Web site.

Pricing Policy

The total price you pay for your accommodation will be stipulated in your confirmation. Different World is entitled to adjust the advertised price to take account of any increase in our supplier’s prices, the imposition of any new taxes or duties, typographical errors, or errors in pricing information from suppliers. Should Different World have cause to adjust the price you will be offered the opportunity to cancel your reservation.

In the event accommodation is listed at an incorrect price we shall have the right to refuse or cancel any reservation submitted at the incorrect price, whether or not the reservation has been confirmed. If your payment has already been processed and we subsequently cancel your reservation, we will immediately issue a refund for the full value of the amount processed.

Currency Conversions

Currency conversion rates are based on various publicly available sources and should be used as guidelines only. Currency conversion rates are not updated every day and Different World does not warrant or guarantee their accuracy. Different World does not authorize the use of this information for any purpose other than personal use, and prohibits to the maximum extent allowable the resale, redistribution, and use of this information for commercial purposes.

Force Majeure

Neither party shall be liable for any delay in performing or failure to perform its obligations (other than a payment obligation) under This Agreement due to any cause outside its reasonable control. Such delay or failure shall not constitute a breach of This Agreement and the time for performance of the affected obligation shall be extended by such a period as is reasonable.

Severability

If any part of This Agreement is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of This Agreement which shall continue to be valid and enforceable to the fullest extent permitted by law.

Notices

All notices required or permitted to be given under This Agreement shall be in writing and shall be sent by email, letter, facsimile or delivered by hand to the registered office address or such other address as the receiving party may from time to time designate.

Waiver

The failure of either party hereto at any time to enforce the provision of This Agreement shall in no way affect its right thereafter to require complete performance by the other party, nor shall the waiver of any breach of any provision be taken or be held to be a waiver or any subsequent breach of any provision be a waiver of the provision itself. Any waiver to be effective must be in writing.

Assignment

The User shall not assign any rights or obligations hereunder without Different World’s prior written consent. Different World may assign This Agreement or any of its rights and obligations on prior written notice. Different World reserves the right to employ sub-contractors but such sub-contracting shall not relieve Different World from its obligations under this Agreement.

Entire Agreement

This Agreement is the entire agreement of the parties concerning the subject matter of this Agreement and supersedes all prior agreements, communications, representations and arrangements, written or oral. The User acknowledges that no reliance is placed on any representation made but not embodied in this Agreement. The printed terms of any purchase order or other correspondence and documents of the User issued in connection with This Agreement shall not apply unless expressly accepted in writing by Different World. Except as otherwise permitted by this Agreement, no variation of the provisions of this Agreement shall be effective unless expressly agreed in writing by both parties.

Governing Law

This Agreement is governed by English law and the User consents to the exclusive jurisdiction of the English Courts in all disputes concerning or otherwise involving Different World arising out of or relating to the use of this Web site or service purchased thereby.
